By using the website, https://mgrealestate.bg, any of its menus, categories or subcategories, sections or subsections, as well as with the emergence, development and termination of any legal relationship arising from the use of this website, you give your consent to be bound by these general terms and conditions for the use of the website, as well as by all other conditions regulating individual legal relationships conditioned by its use.
The binding by the general terms and conditions is applicable both to the current configuration of the website and to all changes made to it in the form of additions and amendments or the introduction of new menus, categories, sections, functionalities and others. „M.G. REAL ESTATE“ Ltd. („MG Real Estate“) reserves the right to unilaterally change the general terms and conditions for the use of the website and the services provided through it at any time, without prior notice, and the changed conditions are published on the website immediately after a decision for their entry into force is adopted.
In connection with the services provided, MG Real Estate processes personal data in accordance with the provisions of the PDPA and „Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data“.

I. DEFINITIONS
The words and phrases used below in these general terms and conditions have the following meaning:
1) MG Real Estate means „M.G. REAL ESTATE“ Ltd., a sole-owner limited liability company, established and existing under the laws of the Republic of Bulgaria, entered in the Commercial Register at the Registry Agency with UIC 206027077, with its registered office and address of management in the Republic of Bulgaria, Sofia, postal code 1700, Studentski district, Studentski Grad, Baku Str. No. 5A, „Green Park“ Office Building, office 1;
2) Website/internet site is a distinct place on the global Internet network, accessible via its unified address (URL) by HTTP, HTTPS or other standardized protocol and containing files, programs, text, sound, picture, image or other materials and resources;
3) User/client of the website is any legally capable natural person who has accessed the website https://mgrealestate.bg;
4) PDPA means the Bulgarian Personal Data Protection Act;
5) Terms and conditions means the present general terms and conditions, as well as all subsequent amendments thereto, published on the website https://mgrealestate.bg;
II. SUBJECT OF THE GENERAL TERMS AND CONDITIONS
1. These general terms and conditions govern the terms and conditions for using the website https://mgrealestate.bg and the services provided through it, and the relationships between MG Real Estate, on the one hand, and the Users, on the other.
2. Access to the services provided on the website is possible only and exclusively through the use of the publicly accessible website https://mgrealestate.bg. The website provides an information array with electronic records („offers for sale“ and „requests for search“ of real estate), corporate information, own and third-party materials in the form of articles and news, statistical and geographical information from external sources, own statistical information on average property prices in Bulgaria, images, graphic images, other materials related to the subject of activity of MG Real Estate. MG Real Estate bears no responsibility for the content of third-party information materials.
3. Offers for sale and requests for search of real estate are collected, processed, and entered into a database by the real estate agents, consultants, and administrators of MG Real Estate.
4. The information is received from MG Real Estate's clients in connection with the brokerage activity carried out by MG Real Estate in the course of its business when concluding real estate transactions.
III. RESPONSIBILITIES
5. MG Real Estate has the right to publish on the website any textual, graphic, and other information related to offers from its own database for advertising and informational purposes; content directly or indirectly related to its real estate activities, in the form of news, articles, publications through textual and graphic elements, providing it for good faith use by Users.
6. You (as a User) may not in any way use, copy, modify, or distribute content that does not belong to you, for purposes other than or incompatible with the use of the services and the purpose of the website, without the express prior written consent of MG Real Estate and/or the respective third parties.
7. MG Real Estate strives to maintain the most accurate and up-to-date information on the website, but due to the dynamics and diversity of the information offered, as well as the fact that information is often provided by third parties under their sole responsibility, Users of the website agree that this (maintaining the most accurate and up-to-date information) is not always possible. MG Real Estate does not assume responsibility for the accuracy and completeness of the information and services, and reserves the right to provide the User with corrected information upon a specific inquiry. In this sense, the information on the website in no part binds or obliges MG Real Estate, but has a purely informative function.
8. You (as a User) undertake to provide accurate data when using the services, in connection with filling out the contact forms on the website. In case of inaccuracy in the data, you do not have the right to use the services until it is corrected.
9. By filling out any of the contact forms on the website, you agree to the general terms and conditions, thereby giving your express consent for us to contact you at the provided phone number, and to receive informational materials from MG Real Estate in the form of email. In every email sent to you, you have the option to unsubscribe from receiving email messages. The User's refusal to receive informational materials does not mean that they reject, amend, or waive the acceptance of these general terms and conditions.
10. MG Real Estate reserves the right to choose to whom to send calls and/or informational materials, as well as to remove individual User contacts from its database for sending calls and/or informational materials without any future obligations on the part of MG Real Estate and without further notice.
11. MG Real Estate undertakes to process Users' personal data lawfully and in good faith.
12. MG Real Estate has the right to unilaterally terminate or restrict without notice access to the website for certain Users in the following cases:

- 12.1. The User distributes via the Internet, SMS or by using services through the MG Real Estate website, messages with advertising, commercial, obscene, offensive, defamatory and/or threatening texts and/or images, including those based on religious, creed or political grounds, as well as those with pornographic content; 12.2.
- The User's actions harm the good name of MG Real Estate, violate the laws of the Republic of Bulgaria or endanger the software and technical means through which the services are provided.
13. In case of unlawful actions as per the preceding point and/or upon request by the competent authorities of the Republic of Bulgaria, MG Real Estate has the right to provide the competent authorities with all available information about the User's actions and identity.
14. MG Real Estate has the right to request additional information and/or declarations from Users in accordance with the Measures Against Money Laundering Act and the subordinate legislation for its implementation, in connection with the performance of a specific operation.
15. The prices of real estate announced on the website may be changed and do not constitute a binding offer for a real estate transaction.
16. MG Real Estate does not assume responsibility for any potential losses, damages, harms, adverse consequences, and lost profits in connection with the use of the website.
17. MG Real Estate is not responsible if the User is misled by third parties who present themselves as representatives of MG Real Estate's interests and offer services on behalf of MG Real Estate, without being explicitly authorized in writing.
18. By using the website and accepting these general terms and conditions, the User gives their explicit, freely expressed, and informed consent for the processing of their personal data. Users„ personal data will be collected and processed by MG Real Estate in accordance with the provisions of the Personal Data Protection Act and “Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data".
19. MG Real Estate has all other rights, as detailed by the current legislation and these General Terms and Conditions.
IV. RIGHT TO CHANGES
20. MG Real Estate reserves the right to add new services, functionalities, and rules for using the website, to change or remove existing ones, without the need for prior warning or consent from Users.
21. These general terms and conditions may be changed in connection with the development, addition of new, modification or termination of existing services or due to legislative changes. When changes are made, they will be brought to your attention or published here.
V. RIGHT OF OWNERSHIP
22. All information from the website and database of MG Real Estate, including offers for sale, requests for real estate search, as well as information provided by third parties and uploaded to the website (including text content, images, graphics, photos, files, etc.), is the property of MG Real Estate.
23. The content of the website may not be copied or reproduced, except insofar as it is not necessary for specific material to be viewed online. Every User has the right to print entire pages from the website for their personal, non-commercial use under the following conditions:
- 23.1. No document or related graphics from the website may be altered in any way;
- 23.2. No graphic from the website may be used separately from the corresponding text;
- 23.3. The copyright, trademark, or other declarations of MG Real Estate must be present in all copies;
- 23.4. The copyrights of MG Real Estate or third parties, directly or indirectly related to the published content of the website, are not violated;
- 23.5. The provisions of these general terms and conditions are not violated.
24. Any use of the content of the website for purposes other than those explicitly mentioned in these general terms and conditions or in another accompanying document, if any, is prohibited.
25. The disposal of ownership rights is done with the explicit written consent of MG Real Estate.
26. When publishing third-party content, we make every effort to clarify the intellectual property rights over photos, texts, graphic solutions, and functionalities. We ask to be excused if we have not been able to identify and contact the author of materials used by us in advance.
27. In case of copyright claims over content, the claimant is obliged to notify MG Real Estate, specifying the copyrighted object and presenting documents of ownership over the object. Upon a request for removal of copyrighted content, made under the conditions of the preceding sentence, MG Real Estate will do everything possible to comply with the author's wish.
28. For any infringement of intellectual property that is subject to protection, according to the present Section V, including, but not limited to, these general terms and conditions, MG Real Estate has the right to a penalty of 10,000 (ten thousand) BGN. This does not limit the right of MG Real Estate to seek liability from the infringer for actual damages suffered and/or lost profits in accordance with the relevant legal procedure.
VI. LINKS TO OTHER SITES
29. MG Real Estate provides the opportunity for all interested parties to create links to the website without requesting prior notice or permission. MG Real Estate may require the termination of an established link if a technique has been used to recreate a specific part of the website as belonging to the persons using the link, without prior consent from MG Real Estate, or if MG Real Estate, at its sole discretion, determines that the used link affects its legitimate rights and interests.
VII. OTHER TERMS
30. These general terms and conditions are governed by the norms of the current Bulgarian legislation.
31. If any of the provisions of these general terms and conditions is invalid or unenforceable to a certain extent, then it shall be replaced by operation of law by the imperative norms of the law and does not entail the invalidity of the remaining provisions of the general terms and conditions.
32. Disputes arising between the parties, stemming from or in connection with the use of the MG Real Estate website, with the exception of those on which both parties reach an agreement, will be referred for resolution to the competent Bulgarian court.
33. The amended or newly adopted general terms and conditions are published on the MG Real Estate website and enter into force immediately.
34. Due to the fact that the services can only be used in accordance with these general terms and conditions, in case you do not agree with them, you should not use the website.
35. The values in euro, shown in parentheses, are indicated solely for the purposes of dual display within the meaning of the Law on the Introduction of the Euro in the Republic of Bulgaria and are calculated at the official exchange rate of the BNB 1.95583 BGN.
