Document of ownership of the property
Most often a title deed, notarized will, sales contract, court decision or prenuptial agreement.
Certificate of tax assessment
Issued by the territorial directorates of the NRA and certifies that the owner has no unpaid building tax and waste collection fees.
Certificate of marital status, spouse and children
Issued by the Civil Registration Office (ESGRAON) of the municipality at the permanent or current address of the seller to assess whether the property was acquired during marriage.
Certificate of chosen matrimonial property regime
Issued by the Registry Agency, Matrimonial Register. The certificate is necessary to assess whether the property is marital property, if the sellers acquired it during the marriage.
Certificate of civil marriage
If the seller is married, a certificate of civil marriage of the spouses must also be presented.
Declaration under Art. 26 of the Family Code
Confirms the consent of the other spouse regarding the transaction, when the ownership of the property is personal, but the spouses use the property as a “family home”), or when they do not have another dwelling – common or personal property of each of them.
Court decision for divorce
If the seller is divorced, they must also present the court decision for the termination of their marriage by divorce.
Sketch of the property
Issued by the Geodesy, Cartography and Cadastre Agency or by the technical service of the municipality where the property is located for areas for which there is no effective cadastral map. The sketch is necessary when transferring land or ideal parts of it.
Scheme of an independent object in a building
Issued by the Geodesy, Cartography and Cadastre Agency for areas with an effective cadastral map. It is valid until a change occurs in the data for the property for which it was issued.
Certificate of administrative address of the property
Required when the property address in the ownership document is different from its current address. For example, if the deed is old and the street has been renamed. It is issued by the municipality where the property is located.
Certificate of heirs
It is necessary when the property has been acquired by inheritance. It is issued by the municipality, district, or mayor's office at the last permanent address of the deceased person.
Certificate of entries, annotations, and deletions for a property (certificate of encumbrances)
Issued by the Registry Agency. Copies of all previous ownership documents up to the first owner, chronologically and logically connected, are attached to the application, and in case of inheritance – also certificates of heirs. If the property includes land or an ideal part of land, a sketch of the property is also attached. The check covers a period of at least 10 years back.
Minutes of the general meeting of partners, of the board of directors, or decision of the sole owner of the capital
When the seller is a commercial company – EOOD, OOD, or AD – a decision from its competent body for the sale of the property is also required.
Construction documents
- When the property is under construction, documents are required depending on the stage of construction.
- Building permit
- Protocol for determining the building line and building level
- Ascertainment Protocol pursuant to Art. 181, para. 2 of the Spatial Planning Act
- Occupancy Permit or Certificate of Commissioning of the building
- Approved architectural designs
- Table for built-up areas and ideal shares of the properties, etc.
Permission from the district court
If the seller is a minor or underage person, permission from the district court for concluding the transaction must be obligatorily presented.
Power of Attorney
If any of the parties – the seller and/or the buyer – are represented by an authorized representative, their power of attorney must be notarized for signature and content.
Declarations
- Declaration under Art. 264, para. 1 of the Tax and Social Security Procedure Code – from the seller
- Declarations under Art. 25, para. 8 of the Notaries and Notarial Activity Act – from the seller and the buyer
- Declaration under Art. 42, para. 2, item 2 of the Measures Against Money Laundering Act – from the seller and the buyer
- Declaration under Art. 59, para. 1, item 3 of the Measures Against Money Laundering Act – from the seller and the buyer, if they are legal entities
- Declaration of origin of funds under Art. 66, para. 2 of the Measures Against Money Laundering Act – from the buyer.
